Details of Joint Controllers

The Directorate for Cultural Promotion (Department of Culture and Linguistic Policy) and the Directorate for Services (Department of Economic Development, Sustainability and the Environment) of the Basque Government (hereinafter, the "Holders"), with registered office in Vitoria-Gasteiz (Álava), Calle Donostia-San Sebastián Kalea 1, 01010, are the Joint Controllers of the data processed through the BDCC website.

Details of the data protection officer

The bodies of the Basque Government have a Data Protection Officer (DPO) assigned to the Deputy Council for Law of the Department of Public Governance and Self-Governance of the Basque Government.

The DPO?s website offers you information on its organisation and functions, as well as providing information about data protection rights and how to exercise them, and how to file a complaint before the Data Protection Officer.

Details of the purposes of data processing

  1. Contact: Users may contact the BDCC using the forms provided for this purpose on the BDCC website. To do so, they must provide personal data, as well as the reason, issue or query involved. The data will be used to process the query and contact the User.
  2. Registration in the tools: To create an account in our tools Users must provide personal data, such as full name and email; this information must also be provided when necessary to process the registration in the tools and to allow access to their functionalities. Once registered, Users may use the tool in question, in accordance with its specific characteristics and features.
  3. Use of tools: Users may use the tools provided by BDCC to obtain more information on the training sessions offered and on the functionalities related to the tools. For this purpose, Users must provide their personal details. The data will be used to allow Users to use the tool and to offer information on its operation and any improvements that may be introduced in the future.

Data storage times

  1. Contact: The data processed for this purpose will be stored for the time needed for this purpose, always in line with the provisions of the laws governing archives and documentation.
  2. Registration in the tools: The data processed for this purpose will be stored while the User is registered in the corresponding tool, and to determine any possible liability. In any event, the provisions of the law governing archives and documentation will be applicable.
  3. Use of tools: The data processed for this purpose will be stored for the time needed for this purpose, always in line with the provisions of the laws governing archives and documentation.
  4. Cookies: The data processed for this purpose will be stored continuously or for one session, depending on the type of cookies whose use has been agreed to.

Legal basis for data processing

  1. Contact: The legal basis for processing these data is necessary compliance with a mission carried out in the public interest and in the exercise of public powers conferred on the Controllers, under Law 39/2015 of 1 October, on Common Administrative Procedure for Governmental Agencies; and Law 40/2015 of 1 October, on the Legal Status of the Public Sector.
  2. Registration in the tools: The legal basis for processing these data lies in the performance of a contract to which the User is party, and specifically, the Terms and Conditions of each tool.
  3. Use of tools: The legal basis for processing these data is necessary compliance with a mission carried out in the public interest and in the exercise of public powers conferred on the Controllers, under Law 39/2015 of 1 October, on Common Administrative Procedure for Governmental Agencies; and Law 40/2015 of 1 October, on the Legal Status of the Public Sector.
  4. Cookies: The legal basis for processing these data is based on the User?s consent.

Obligation to provide data

Access to the BDCC website and use of the tools and functionalities offered in them is without charge, free and voluntary, so there is no legal obligation to provide the data necessary for the purposes described above. The provision of the various services available on the BDCC website will be carried out on request in accordance with a mission in the public interest and in the exercise of public powers conferred on the Controllers.

Recipients of the data

The data provided by the Users may be communicated between bodies and entities belonging to and/or assigned to the Department of Culture and Linguistic Policy and the Department of Economic Development, Sustainability and the Environment of the Basque Government.

Data processors

The data provided by Users will be assigned for processing to Asociación de Industrias de Conocimiento y Tecnología (GAIA), with NIF ESG20082509 and registered office in Portuetxe Bidea, 14 Donostia-San Sebastian 20018 Gipuzkoa.

Data protection rights

The User may revoke consent for data processing and exercise the rights of access, correction, deletion, portability, objection and restriction to the processing, making this known to BDCC by sending an email to info@basquedcc.eus; by notifying the address indicated above; or through the service Exercise of data protection rights on the website of the Data Protection Officer of the Basque Government.

In cases where there are doubts about the identity of the person exercising the rights, the User will be required to provide a copy of the official document certifying identity, with the aim of preventing access to the User?s data by unauthorised third persons.

In any event, the User may file a complaint before the Basque Data Protection Agency to assert their rights, or file a complaint first before the Data Protection Officer of the Basque Government.

Modifications

The Joint Controllers reserves the right to modify this Privacy Policy at any time, in respecting of the legislation in force in terms of data protection and following advance notice to the data subjects.

Language

The languages applicable to the Privacy Policy are Spanish and Basque. If versions in other languages, such as English, are provided, it will only be for the User's convenience. In the event of any contradiction, the Spanish and Basque versions shall prevail.
